These Terms of Service ("Terms") govern your access to and use of the Nivaar website and services at nivaar.net and examprep.nivaar.net (the "Services"), operated by Nivaar ("Nivaar", "we", "us"), based in Toronto, Ontario, Canada. By creating an account or using the Services, you agree to these Terms and to our Privacy Policy.
Accounts are created by request and may require approval. You are responsible for keeping your credentials secure and for all activity under your account. You must provide accurate information and be authorized to use any email address you register or share with.
New accounts may receive full access to Nivaar services free for the first three months, with no credit card required to start. Paid subscription plans may be introduced later; we will give notice before any charges apply. P.Eng Exam Prep access is purchased separately from other Nivaar services. Payments are processed by Stripe.
You agree not to use the Services to:
You retain ownership of the panoramas, data, and files you upload ("Your Content"). You grant Nivaar a limited licence to host, process, and display Your Content solely to operate the Services for you and the recipients you choose. You are solely responsible for the recipients you invite and for ensuring you have the right to share what you share. When you create a share, we send transactional email to the recipients you specify.
Nivaar Exam Prep provides our own worked re-statements and study guides created for study purposes. The original examinations are © EGBC / CEQB, and Nivaar is not affiliated with or endorsed by EGBC or CEQB. Exam Prep materials are licensed to you for personal study only and may not be redistributed or resold.
We work to keep the Services available and reliable but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features with reasonable notice where practicable.
You may stop using the Services and permanently delete your account and the content you own at any time from your account page. We may suspend or terminate accounts that violate these Terms. On deletion, your account and owned content are removed as described in our Privacy Policy.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. You are responsible for maintaining your own backups of important content.
To the maximum extent permitted by law, Nivaar will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve months before the claim.
We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, notify you. Continued use of the Services after changes take effect constitutes acceptance.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The courts of Ontario will have jurisdiction over any dispute, subject to any mandatory consumer-protection rights you may have.
